Notification of PACEP Proposed Bylaws AmendmentsFebruary 24, 2020

As PACEP Secretary, I present for your review, comments, and voting suggested revisions to the PACEP Bylaws. Click here for additional details.
This year is unique. The ACEP Bylaws Committee performs scheduled, detailed reviews of each Chapter’s bylaws every several years. In 2019-2020, the PACEP Bylaws underwent this review. Your PACEP Board of Directors and Executive Leadership participated throughout the process, actively engaging in discussions with the ACEP Bylaws Committee and ACEP Staff.
The PACEP Board of Directors and Executive Leadership present the following for your consideration:
- The suggested revisions, with the exception of #2 below, should be ratified via “amendment by substitution.” These “housekeeping” revisions bring our PACEP Bylaws into alignment, both in structure and language, with Model Chapter Bylaws used by other ACEP Chapters and ACEP. If you vote to “amend by substitution,” the revisions will be accepted in whole and will replace the current Bylaws.
- Re: Article VI, Section 4B. A second, separate vote should focus only on this Section. Currently, PACEP members can vote for any number of candidates up to the number of open positions on the Board. The ACEP Bylaws Committee, and PACEP Board, recommend revision so that the number of votes on a valid ballot is the same as the number of positions to be filled. For example, if there are 2 Board positions to be filled, a valid Ballot must have 2 unique votes. “Cumulative voting,” in which a member casts multiple votes for a single candidate, would not be permitted. This proposed change in voting process, to be codified in the revised PACEP Bylaws, is intended to ensure the continued equity and integrity of the election process and to minimize the influence of large voting blocks to secure election of a single or several preferred candidates by not selecting a full complement of candidates. This proposed change would reflect the practice of other Chapters that are similar in size and composition to PACEP and is consistent with the process used by the ACEP Council to elect the ACEP Board of Directors, the ACEP President-Elect, and the officers of the ACEP Council (i.e. the ACEP Council Vice-Speaker and Speaker).
